Terms of Service
Effective date: July 15, 2026
These Terms of Service ("Terms") are an agreement between you and Serenity Software ("Amplifier," "we," "us," or "our") governing your use of beamplified.app and the Amplifier service (the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms. You must be at least 18 years old and able to enter a binding agreement.
Accounts and workspaces
You must provide accurate information, protect your credentials, and promptly tell us about unauthorized use. A workspace owner controls its membership, connected accounts, and billing. You are responsible for activity under your account and for ensuring you have authority to connect and act for each social account.
Subscriptions and billing
Paid plans are recurring subscriptions processed by Stripe. The price, billing interval, applicable taxes, and any trial or promotion are shown before you confirm checkout. Your subscription renews automatically until canceled. You authorize Stripe and us to charge the payment method on file for each renewal and any applicable taxes.
The workspace owner can update payment details or cancel through the Stripe customer portal linked from Amplifier. Cancellation takes effect at the end of the current paid period unless the portal says otherwise. Fees are non-refundable except where required by law or expressly stated at checkout. Failed or overdue payments may result in limited or suspended access. We may change future prices with advance notice required by law; the new price applies no earlier than a subsequent renewal.
Your content and connected services
You retain ownership of content you submit. You grant us a limited license to host, process, transform, transmit, and publish that content only as needed to operate the Service and follow your instructions. You represent that you have the rights needed for the content, accounts, audiences, and data you use.
When you schedule a post, enable Auto-Pilot, fetch interactions, or approve a reply, you authorize Amplifier to take that action through the connected service. Third-party platforms have their own terms and may change, restrict, reject, or remove content or access. We are not responsible for a third-party service's acts, availability, or policy decisions.
AI-generated material
AI output may be incomplete, inaccurate, similar to other material, or unsuitable for your audience. You are responsible for reviewing output and for content you publish. Do not rely on Amplifier for legal, medical, financial, or other professional advice.
Acceptable use
You may not use the Service to:
- Break the law, infringe rights, impersonate others, or distribute deceptive, harmful, or illegal material.
- Send spam, manipulate engagement, evade platform limits, or violate a connected service's terms.
- Upload malware, probe security, disrupt the Service, or access accounts or data without authorization.
- Resell, reverse engineer, scrape, or systematically extract the Service except where law allows it.
- Use the Service or its output to build or train a competing model or service without written permission.
Our service and intellectual property
We own the Service, software, design, trademarks, and related materials, excluding your content and third-party materials. We grant you a limited, revocable, non-transferable right to use the Service under these Terms. Feedback may be used without restriction or compensation. We may change, suspend, or discontinue features, and we do not promise uninterrupted or error-free operation.
Termination
You may stop using the Service at any time. Cancel a paid plan before deleting its workspace or account; Amplifier also attempts immediate cancellation when a paid workspace is deleted. We may suspend or terminate access for material breach, unlawful or harmful use, nonpayment, security risk, or where required by law. Provisions that by their nature should survive will survive termination.
Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMPLIFIER AND SERENITY SOFTWARE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, GOODWILL, OR BUSINESS. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
General
These Terms and the Privacy Policy are the entire agreement about the Service. If a provision is unenforceable, the rest remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, or sale. Pennsylvania law governs these Terms, without regard to conflict-of-law rules, except where your local law requires otherwise. We may update these Terms and will provide notice when required. Continued use after the effective date means you accept the revised Terms.
